2. Terms and Conditions of Use

Sales through this website are exclusively for companies or professionals in the sector who intend to resell or use our products in their business. Under no circumstances shall the client be regarded as a consumer under Royal Legislative Decree 1/2007 of November 16, which approves the consolidated text of the General Law for the Protection of Consumers and Users (TRLDCU).

Accessing the website www.grupoerik.com or placing an order implies acceptance of these purchase conditions, as well as those contained in the company’s Privacy Policy. If you do not agree with any of these terms, please discontinue using the website.

These terms, as well as the website’s content, design, and structure, may be reviewed and/or modified at any time. Should they be updated, the new text will be published immediately and will become applicable at that time. To stay informed about the current conditions, clients must review them periodically. Use of the website—including access and navigation—is free of charge and implies compliance with these terms, Spanish legislation, and accepted standards of good conduct and Internet practices.

These conditions apply to all clients using the website. However, if new sections offering specific services are added in the future, GRUPOERIK may include special conditions for those sections, either taking precedence over these terms or supplementing them.

Although GRUPOERIK strives to provide continuous service through the website, it may be interrupted due to various circumstances. In such cases, GRUPOERIK will attempt to notify its clients in advance, whenever possible.

The contract may be formalised, at the client’s choice, in any of the languages in which the conditions are available on the website.

These terms prevail over any previous written or verbal agreement between the parties and may only be overridden by subsequent, specific agreements granted in writing.

If the parties have also signed an agreement for the periodic supply of products, these conditions will be integrated into that agreement, unless explicitly agreed otherwise in writing.

If any of these terms is declared wholly or partially void by any court or competent administrative authority, such nullity shall not affect the rest of the provisions, which will continue to apply. The GRUPOERIK website will indicate its membership in relevant codes of conduct or trust seals, copies of which may be requested through our customer service via the channels listed in section 8.

3. Offered Products and Purchase Procedure

The products offered by GRUPOERIK are listed on the website, including detailed information about their characteristics and compatibility.

Purchasing on www.grupoerik.com is available only for professionals who are already registered. Registration is conditional upon submitting an IAE certificate or census declaration and its verification by GRUPOERIK.

During registration, the client chooses a username and password and is solely responsible for maintaining the confidentiality of their account and password and for all actions carried out under their account. The client must also immediately inform GRUPOERIK of any unauthorized use of their account and/or password and must log out at the end of each session.

Once registration is complete, a confirmation will be sent to the client via email or any other communication method enabled by GRUPOERIK and accepted by the client, indicating that they must submit a copy of their census declaration or IAE to atencionalcliente@grupoerik.com so that their account may be validated. The client may delete their registered account via the following methods:

Deleting the account results in the loss of any previously obtained discounts or benefits.

Purchase procedure:

  1. To access the catalogue and purchase products, the client must be registered and have their account validated. After logging in, they select the desired products and add them to the cart using the relevant icon.
  2. The cart will display the selected products and their corresponding prices. Prices do not include VAT or shipping costs, which will vary depending on the shipping method selected and the delivery address provided.
  3. To place the order, the client must complete their personal details, which will be added to the company’s database and processed in accordance with our Privacy Policy, in order to process the order. If the shipping address differs from the billing address, this must be specified in the address section of the order. Before completing the order, a summary will appear showing the products to be purchased, shipping details, and total price—including breakdowns of taxes and shipping costs. The client can modify the order details before proceeding by accepting the purchase conditions and clicking “Pay.”
  4. Once the purchase has been completed, the client will receive a confirmation email within a maximum of 24 hours, outlining the order details. If the email is not received, the client should check their spam folder or contact customer service.

The client must provide correct personal information to avoid order processing issues. If the client notices any errors after placing the order, they must immediately contact customer service to correct it. Client may contact GRUPOERIK’s customer service by phone or email as listed in section 8.

Delivery of ordered products and quantities is subject to availability. If, after placing the order, stock is found to be unavailable, GRUPOERIK will contact the client as soon as possible to inform them and, if appropriate, provide a new delivery date. The client may choose whether to accept it or to cancel the order with a refund.

GRUPOERIK may cancel an order if there are indications of fraud or if the client is a minor, if delivery to the provided address is impossible, or in case of force majeure beyond GRUPOERIK’s control. In such cases, all paid amounts will be fully refunded.

GRUPOERIK will not be liable if delivery fails because the client has provided false, inaccurate, or incomplete information. In such cases, the product price will be refunded, but not the shipping costs.

4. Price and Payment

Product prices displayed on the website are in euros and may change at any time.

Promotions are marked as such. They remain valid while displayed on GRUPOERIK’s servers (not via proxy or cached services).

Prices of display stands are subject to approval by the commercial department for each client; please contact us at atencionalcliente@grupoerik.com. All prices listed on the website exclude VAT, which will be separately itemised during checkout. The applicable VAT rate will be the one in effect at the time of purchase. Any changes in the VAT rate will be automatically applied to sale prices.

The product price will be the one shown at checkout. If an obvious pricing error is detected after placing an order, the client will be promptly informed and offered the option to reconfirm or cancel the order at the correct price without any cost. If GRUPOERIK cannot reach the client, the order will be considered cancelled and fully refunded. GRUPOERIK is not obligated to supply any product purchased at an incorrectly low price if the error was obvious and the client should have recognised it.

Shipping costs will be calculated prior to order confirmation based on delivery method and address. They will be itemised in the order summary.

Products offered can be shipped nationally and internationally; shipping methods and terms will update based on the destination country.

Shipping costs may be changed at any time without notice; however, the costs in effect when placing the order will apply. International shipments outside the EU may incur customs duties or other charges that vary by country and are beyond GRUPOERIK’s control. Such charges are borne by the client. GRUPOERIK will provide necessary documentation for customs clearance.

Any active discount or promotion may be applied directly to the client’s order once eligibility requirements are verified.

Upon purchase, the client will receive a paper invoice with their order.

Payments are accepted via credit or debit card (Visa, MasterCard, American Express, JCB, Diners, and UnionPay) processed through the REDSYS gateway, or via bank transfer.

If payment is made by bank transfer, payment details will be provided with the order confirmation. The client must send proof of transfer to atencionalcliente@grupoerik.com within 5 calendar days. Bank transfer orders depend on the receipt of payment, which may take up to four business days. If payment is not received within this period, GRUPOERIK reserves the right to cancel the order.

5. Product Delivery

Purchased products will be made available at the delivery address provided. The risk transfers to the client upon delivery. The order is considered delivered when the client or a designated third party signs for it at the agreed address. Shipping is done via a courier service within the timeframe indicated on the website, depending on shipping method and delivery address. For in-stock products, delivery within mainland Spain typically occurs within 2 to 4 business days (Monday to Friday).

Delivery times are approximate and may vary. Delays do not entitle the client to cancel the order or claim damages or interest. The maximum delivery timeframe is 30 calendar days from order confirmation.

6. Returns

Purchases made through this website are non-returnable unless the return is due to circumstances beyond the client’s control. Specifically, GRUPOERIK accepts returns (with shipping costs covered by GRUPOERIK) in the following cases:

  • The products received do not match the order.
  • The products delivered are defective or damaged due to handling or transport.

In these cases, the client must notify customer service immediately by email or phone within 4 days of delivery, providing invoice number, product reference, quantity, images or video of the item, and retaining the original packaging.

If the end consumer reports a hidden defect, the professional client must inform Grupo Erik within 7 days of the consumer’s notification. Grupo Erik agrees to assess the situation, apply the warranty if applicable, take appropriate measures to resolve the issue, and refund the client the amounts paid to the consumer, if justified.

Within 2 business days after notification, GRUPOERIK will contact the client to confirm whether the claim is valid or to request further justification for the return.

If the return is accepted, the client must send the products according to GRUPOERIK’s instructions. A refund will be issued within 30 days once product condition has been verified. If there is any discrepancy in packaging condition, it must be noted on the delivery receipt and signed. The client must report the discrepancy to GRUPOERIK within 48 hours, otherwise GRUPOERIK cannot be held responsible for product condition.

If the specified procedure or deadlines are not followed, the client will not be able to file any claim for non-conformity or defect. The products will be considered in conformity with the order and free of defect.

No refunds will be issued for products not in their original condition or that have been damaged. Products must be returned in their original packaging with all components and accessories.

Certain products may exhibit variations in texture or colour due to the materials used; this is not considered a defect.

7. Assignment of Rights and Obligations

The client may not assign or transfer their rights or obligations under contracts with GRUPOERIK without prior written consent.

The failure of GRUPOERIK to enforce any right or action under these terms shall not be construed as a waiver of such rights or actions, unless expressly waived in writing.

9. Jurisdiction and Applicable Law

For any dispute arising from access to or use of this website, the client and GRUPOERIK expressly waive any other jurisdiction and submit to Spanish law and the exclusive jurisdiction of the courts of Motril (Granada).
